UN Procedures under the Convention on the Rights of People with Disabilities (CRPD)

As widely reported in the press an online campaign group Disabled People Against Cuts have reported to the UN to raise the grave violations against disabled people in the UK. Many do not understand the procedures surrounding this as it is very complex. The rest of this Blog is written (name supplied) by a guest person who can explain it to those of us who don’t understand it,  so we understand how important  and ground breaking this really is.

How the complaints mechanism to the CRPD applies.

The CRPD Is an international treaty, an international legal instrument known as a ‘convention’, to which the UK Government is a signatory State and ratified in 2009; therefore ratification means that the UK Government has agreed with the United Nations (UN) to be bound by the terms of this instrument. In addition to ratification of the main instrument the UK Government has also signed the Optional Protocol to the CRPD, (OP) acknowledging that as a State Party to the OP ‘recognises the competence of the Committee on the CRPD to receive and consider communications from or on behalf of individuals or groups of individuals to its jurisdiction who claim to be victims of a violation by that State Party of the provisions of the Convention’.

 

The Committee for the CRPD is a ‘treaty body’ invested with power to monitor the implementation of the CRPD, within signatory member States. This treaty body constitutes a body of independent experts.  As with other UN treaty bodies equipped with complaints mechanisms, the CRPD Committee is not a court with judicial powers; the Optional Protocol to the CRPD provides a quasi-judicial procedure; this means that decisions of the CRPD Committee are not legally enforceable such as domestic court judgments, or some other regional judicial mechanisms (as seen with decisions of the European Court of Human Rights).  If a violation is found, the Committee’s views are communicated to the State party involved, which constitute recommendations which need to be implemented.  Technically, such recommendations may not be legally binding, however, decisions of the CRPD Committee will be authoritative interpretations of the CRPD, therefore beyond the realm of application within the State party (in this instance the UK Government) involved in a complaint.  Decisions will be of great value in the exercise of implementing provisions on the ground in ALL States parties to the CRPD.

 

Ultimately, the effectiveness of the communications mechanism depends on political will of the State party (here the UK Government) to recognise the Committee’s competence, AND to abide by their decisions. Initially, the use of the communications procedures depends on sufficient awareness of the instrument and the capacity of individuals, organisations of persons with disabilities and Non-governmental Organisations to identify victims, recognise violations and lodge complaints to the Committee in accordance with provisions of the OP.  The Committee for the CRPD is already facing great constraints due to few resources and limited time for meetings allocated to them.

 

Awareness of the OP to the CRPD can be achieved via publication of communications lodged to the CRPD Committee. The CRPD Committee treats all communications confidentially: it is the prerogative of the individual or group of persons or victims of violations, to decide for themselves whether they wish to make their complaint public.  It may be their complaint has already been made public as a result of domestic court proceedings.  A simple press release when lodging the complaint can help raise awareness of this mechanism and lead others to its utilisation.  If this information is being disseminated by a disabled persons’ organisation or non-governmental organisation, or an author of the communication on behalf of the individual or group, it is imperative to obtain their express consent to publicise the case.  Additionally, it is possible for the victim(s) to protect their anonymity when making such communication public.

 

Procedure after registration of the complaint.

Once a complaint has been registered, the case will be transmitted to the UK Government, who will be given an opportunity to provide its observations on the admissibility and merits of the communication. The UK will be given a deadline of six months for its observations on admissibility and merits; two months for the observations on admissibility only.  Once the UK Government submits its observations, they are transmitted to the complaint(s) for comments.  Once the author’s comments are received, the case can be considered by the Committee.

 

The whole procedure is carried out in writing: there are no oral hearings. During examination of a communication, the Committee may obtain documentation from other organisations within the UN system or bodies which may be useful in consideration of the communications, provided the Committee can afford each party an opportunity to comment within fixed time limits.

 

Determination of admissibility and a decision on the merits of the complaint(s) is usually considered simultaneously and may be split at the request of UK Government (if the Government contests admissibility within two months of being communicated the case by the Committee). Any decisions on admissibility and/or the merits are determined within the Committee by a simple majority and transmitted to the author of the complaint and the State party simultaneously.

 

If the Committee finds that the UK Government has failed in its obligations to the individual or group of individuals, recommendations will be issued to the UK Government for provision of a remedy for the individual /group concerned and the Committee will request a follow up of information within six months. The Committee’s final decision on the merits of a case or of a decision of inadmissibility is posted on the website of the Office of the High Commissioner for Human Rights.

 

Interim measures.

At any point after receiving a communication, and before a determination on the merits is reached, the Committee may transmit an urgently requested consideration to the UK Government. This request is for interim measures to be made, to avoid irreparable damage to the victim(s) of the alleged violation.[1]  If the author of a complaint wishes to request the Committee to consider undertaking interim measures, the original complaint should have stated so at the outset, or if the need arises at a later period, an urgent request should be transmitted to the Committee.  The risk of irreparable harm must be imminent, real and personal.  The UK Government could contest the continued application of interim measures, and on the basis of their explanation or submitted information, interim measures can be withdrawn by the Committee

 

Follow up to the Committee’s decision.

The UK Government would then be invited to provide information on implementation of the Committee’s views within six months of their decision. At this point in proceedings the Committee shall designate a Special Rapporteur or working group for follow-up, to establish measures to be taken by the UK Government and determine whether effect has been given to the Committee’s views.  In the context of follow-up activities, the Special Rapporteur or working group may make contacts and take action appropriate to their mandate, for example with the approval of the Committee and the State party itself, they may make necessary visits to the UK. Follow up activities will be regularly reported to the Committee and to the UN General Assembly, in the Committee’s biennial report.

 I hope that this helps my readers understand the complex way UN works and  acknowledge those who have worked tirelessly to put disabled peoples concerns forward, in a bid to bring the UK and particularly IDS to justice.

Dear Iain Duncan Smith

I am appalled at the way citizens of the UK are treated under your government. While many who can work should, you are targeting the many to catch a few fraudsters with your pernicious welfare reforms, leaving people without the support they need which we were promised would be protected. Many lives have been lost due to the fear you have installed in those with serious health conditions, and many terminally ill people have had to fight to get their monies restored due to the sheer incompetence of those instructed to carry out your policies in your department and failure to apply the legislation correctly. The underhandedness of your policies and department know no bounds to cruelty inflicted on those who struggle daily with their health.

Let’s be frank, compassion and honesty is not your or your parties best attribute is it?

The deliberately misleading language used by yourself and your department to turn the public against those genuine claimants has caused many to be subjected to assault and abuse in the street, wrongly being accused of fraud by jealous neighbours, believing your untruths. Children left in poverty because their parents they were found to be overpaid by your department in error yet made to feel criminals. What children will remember is that this government is cruel and heartless and lacking in compassion and how many nights they had no food until mother called in at the food bank, which saved them from starving yet still not providing them with a healthy balanced diet a child needs to flourish and possibility of ill-health in the future due to their diets. Children will remember how cold they were due to no heating.
Many disabled people do work, yet you are taking away their cars under PIP and cutting Access to Work for many and this is not going to get more people working. The sanctions regime is out of control by power crazed JCP staff to meet their performance targets or face disciplinary themselves. Even JCP staff are suffering from Mental health issues such as stress and anxiety in the workplace which doesn’t bode for a happy workplace environment which is also counter productive to cut down on sick days, with some eventually being made so ill that they end up becoming reliant on social security payments themselves adding to the vast numbers already claiming.
You are not creating Long Term Employment and apprenticeships of real value it is all done with use of extreme coercion or you will strip their financial lifeline from them for not working hard enough, beer budget schemes to hide the real statistics as they move from one benefit to another.

Your government is punishing those who did not create this mess at the expense of a tax cut for those who refuse to pay their fair share taxes out of pure greed. Lets face it they wont miss a few extra quid many of them spend that in a fancy restaurant over the weekend. In your speech you gave a personal story about your family and about the work ethic they instilled in you, well that’s the same for many other families too, nothing wrong with that, but for those who through no fault of their own cannot work or those who cannot find employment to, make sure their basic needs are being met, you have chosen to beat them into submission and deprivation with the proverbial stick.
That to me is a bullying someone who you and your ilk deem of less value and worth than you and your cohorts. You play the victim card and bemoan those who verbally attack you as bullies often do, when people stand up for their rights to have a fair ,just, equal chance to aspire as any other ,there will always be some who cannot work due to the severity of their disability or chronic health conditions which in many cases, there will always be a person who had poor start in life that fails to thrive and gain meaningful employment due to inability to understand what society expects, but most hardworking citizens in this country do what is right ,they work hard ,pay their taxes to provide for families and bring them up to be fine upstanding citizens who contribute to society. Many of these people paid into the National Insurance Scheme over their working lifetime,  god forbid they find themselves needing a helping hand and some point in life’s journey and the clue here is ‘insurance’ which like many believe that insurances taken out should be honoured when they come to cash in their hour of need.

Generations to come will remember the harshness of this government and the poverty they endured while your party are in power and hopefully will ensure never to entrust your party again with the Conservative way of thinking.
I’m old now but my pension has not only been cut but I have to wait longer for it providing I live long enough to collect it, I cannot get the help I need from social care and have no family close by and im still classed as working age so are subjected to the humiliations of constant reassessments due to ill-health from a botched operation. I did not choose to be on social security as this benefits nobody, life unfortunately deals you obstacles we have to try overcome best way we can.
Unlike you Sir I don’t have money in the bank from family or any that I could have saved for a rainy day as soon as I had paid my way and brought up my family on what I had, the only thing left was my bus fare to go to work the following week. I didn’t mind living on the breadline because I accepted that was my lot in life. This government does not fill me with aspiration but exasperation at the lack of care and compassion for my fellow human being’s, who, like me live in poverty that has to skip a meal to make ends meet.
May god forgive you in your blindness to the suffering you are causing to the many and to those left behind because their loved ones are no longer with us because of your governments vile, destructive, dehumanizing policies which help only those whose greed knows no bounds.

You are a clever master of deception but  many of us are no longer fooled.

A desperate plea to the people of the UK

This plea to all those in the UK who love their country and those who live here.

Please stop believing all the Tory Lies about lazy scroungers, left wing lunatics, Racist bigotry, problem families, terrorists and many other labels they place on people in our communities turning each human being against another.

Have we learnt nothing from history of two world wars?

This government is ruling by fear, fear of your neighbours and friends, fear of those who are not indigenous to our country, fear of paying a little extra tax to help those in need, while they sell off family silver of our country to line the pockets of the few greedy, selfish individuals who see you as less worthy as a human being.

Have we really sunk into an uncaring nation that once made us the envy of the world of fairness and justice& freedom from human rights abuses? If this is so, then we really are in trouble because if you do not wake up fairly sharp you will not have a country of freedom, but one of where your freedom is controlled by the state, which frankly we are not far off a dictatorship. Our country has the United Nations investigating it for violating disabled peoples rights and it will not stop with just disabled people, like a Black Death virus it will spread to other groups in society also.

Governments past and present caused the global crash yet the ordinary people of this country blame everyone except the government because state controlled media and press tells them too. Are we really that asleep, many of you are awake, some are coming to that realisation but far too many are ready to condemn those who rise up against such a vile regime we have now in office. I ask you to rise up before it is too late and a repeat of 1930 occurs again, your complicity is maintaining their power to walk freely to do as they wish without consequences for their actions. The people of this country do take responsibility, time to make our government do the same and remove them from office before their damage inflicted on billions here and around the globe is too powerful to stop. Where we see children in poverty not seen since WW2, where our streets are littered with the homeless, where disabled people have no voice or rights, where workers have all their rights stripped away, where those who speak out are stripped of any legal redress, where the elderly are left to die because they cost too much to care for, our young brainwashed by educational system with state run ideological programs.

I am not saying we should not contribute to overall well being of a stable society, we all can and should where we are able, we should protect those who are not able through ill health or disability, we should work if we are able, we should educate ourselves so we are able to make a better world for all to live in, we should take care of our planet too, but most of all we should love and respect each other for what we are able to do and not make others feel unworthy, we are not all the same for a good reason but we all contribute in some way. Please stand up and be counted and stop this madness before it really is too late for humanity. Lets put back care and compassion on the agenda and go back to what made us the envy of the world.

Truth About Welfare Budgets and the Taxpayers Money

Nearly everyday in the press or  TV or on social media we hear that cry “Why should I pay my taxes to keep lazy scroungers in life on comfort, get a bloody job!”  Well guess what those decrying benefit claimants are predominantly the ones claiming and the ones also using food banks and Housing Benefit/Council Tax/SMI (supported mortgage interest)  to top up their low incomes because their wages are minimum at best.

Well I suggest the next time you bash claimants for having that big TV  or Wi, Xbox,  think again, because you are also one of those claimants. Many claimants had lives before unemployment struck them  which afforded them such items, many had them before they became disabled and too ill to continue , and most of them also paid their taxes and still do pay stealth taxes like VAT  except those born so severely disabled they need 24/7 care which is fine they shouldn’t be expected to help ,we should help them remain living independently.

It still shock me that people are so ill-informed, ignorant or gullible to swallow the rhetoric from both Tories and Lib Dems & Labour benches. It also annoys me those who blame immigrants for taking jobs etc which is total bullshit to turn groups of people against each other so we don’t keep an eye on the ball to how much our elected leaders take so much more of your hard-earned taxes to offshore in a bank account in Jersey  or Cayman’s.

Seriously People need to wake the fuck up and get a grip of their bigoted views and selfish attitudes of ‘Im Alright Jack’ mentality. What about care ,compassion and some humanity for those not so fortunate, after all it can happen anytime to anyone. we are one pay packet away from losing a job in today’s climate, one accident from being so seriously disabled, and many who do take carers roles within the family unit are paid very little and save this country a fortune, selflessly giving up their hopes and dreams to care for their loved ones.

1)      A TUC survey showed that people think around 41% of benefits go to the unemployed, the real figure is 2.6%.   (1)

So next time you feel superior and get indignant on how your taxes are spent think before you speak, because I’m sure when you do you will see the truth behind this governments rhetoric. Instead look at the messengers of hatred and their profit driven ideologies you will find that is where your hard-earned taxes are being wasted and stored.

Patriotism/Nationalism Argument in the UK?


 

 

 

jack britainjpgNow the UK is made up of 4 nations, Scotland, Northern Ireland, Wales , England yet the political climate at the moment our people crave changes for its survival for future generations. Each nation wants devolution to manage it own affairs rather than a Central Westminster that governs all . The UK has never been such a divided country for centuries as it is in 2015. On social media/press it has set our fellow-man against each other like never before. I question whether it will break up the UK as we know it.  England , N Ireland and Wales have a certain amount of control over what happens and where central government money they are given is spent, yet when the Scots ask for same all hell breaks loose. The independence debate divided the Scots  let alone the rest of UK,and the government is already talking of making laws to make sure English MP’s only vote on English issues yet no comment re the other two countries will they be dealt the same blow as Scots. Now controversial as it seems if we all pay into the pot via taxes then surely they should all have a say in how those taxes are spent in their own countries? We can all govern our own countries while still remaining to be a United Kingdom on issues that affect us all.

 

The Scots have always been a passionate nation  not afraid to be forthright in speaking out, just as Ireland and Wales have had their own battles, and it’s not as if England wouldn’t say ‘stuff you’ to other three if push came to shove, because they would.

Don’t get me wrong I love this country but I can’t see why devolution in part wouldn’t help all of us, after all we are part of Europe and have to negotiate with other nations so why can’t we do same here within the UK without discourse. I would like us to stay together as one, but I also understand why each countries people want to have some control over what happens in their own backyard where they know what is needed and where funds need to go as priority. Some will argue it would be disastrous and breaking up the UK and lead to inner turmoil between the nations and take us back hundreds of years where feuds will break out, but we have come a long way since those days and I think we can sort a deal in which all can live in harmony, just as we do now, while gaining some control over what happens in our own backyards.

One thing I dislike is the need to demonize each other as some sort of infidels trying a power grab and assuming they would destroy the other, when it wont realistically happen.  All in the name of votes for a party which is based on corruption of those at top vying for that last vote that will give them overall control of its population to inflict its policies which isn’t equal or fair to the many, but in favour of the few.

This is why we need change in UK and a radical one at that, where the people decide not the party elite, we are just pawns in the ‘big society’ game plan by all main parties but if we are to survive internationally we need to come to terms that change is needed and must be enacted while remaining part of Europe for businesses are to flourish on the world stage, where our influence as a nation can still mean we have a say. Westminster will always have a central role in the distribution of money of our countries needs nation by nation because all our major banking houses are in London.

Rejoice or Despair that is the choice?


 

I am sitting here at a silly hour writing this because I Care!

I have seen the political rhetoric in the last two years in particular destroy our society, one that cared about each other and helped out where they could, where communities stuck together until Maggie put paid to those valuable qualities in the 80’s.

Why do I say this, well I will explain some cold hard facts to those who feel it is ok to attack their fellow man. Let’s make one thing clear, the banks caused this recession NOT the people.

Yet day after day our subconscious is battered with stories in various forms of media of the benefit scrounger, workshy, strivers, uncontrollable youth and the immigrant card instilling fear and dread in a once caring nation. We are encouraged to report various groups of people to various departments in government, from a self righteous standpoint because ‘it’s the right thing to do’. I call them the ‘people police’ doing the states job for them and causing untold distress to those who may have upset a neighbour or friend or ex partner etc out of pure spite, 99% are malicious, let alone the misery it can cause to children affected by this ‘dib’ thy neighbour culture. Yet many of these people police have no qualifications to do so or even make such judgements and calls on other members of society, simply put, we don’t know anyone’s circumstances just that assumptions are made because the state has told us do so to be ‘a good citizen’.

In this day and age that cannot be right or just, by any stretch of the imagination. A nation is indeed judged by the way it treats the most poorest in society. It is a national disgrace that our country is being destroyed by a few wealthy individuals who pull strings, both with politicians and banks and royalty.

Indeed they are all in it together across all main parties.

Human life is no more than a commodity to trade as stock (yes that is what they call us) and treated as collateral damage for the greater good, by those in power, while the average person struggles to survive to have any kind of job, feed the kids, and to get a decent education and decent healthcare. As a chronically sick and disabled person I have been subjected to the dreaded Atos litmus test twice, I have been called a scrounger who fakes their illness; I have been subjected to the new trend of disability hate crime too, because to look at me I look ok, my conditions are hidden except for my white cane.

While many vie for pole position in the upcoming party conferences the rest of society is wandering around aimlessly wondering what to do to survive the torrent of policies that have undone 60years of the Welfare State and the rush to privatise everything they can lay their hands on, before they get voted out even though it is suggested in polls they may actually gain a second term in office, and that all parties are squabbling within to scramble to the top lucrative job of running our country.

The people of this country need to wake up and take control of this matter with great urgency and give our country a fighting chance of real survival of its population.

The Welfare State covers many things not just benefits. Our elderly population costs the most in benefits 42.3%, our jobless cost us 2.6% of the national welfare budget (DWP), and our low income families cost 20.8%, working families 18.4% and our sick and disabled 15.5%. The train crash policies of austerity failures cost the taxpayer far more, by a government that bungles almost everything it touches, u-turns are rife and actual fraud is overall 0.7% some of which 0.2% are departmental errors. So the scare stories you read and hear in the media are in fact mostly fictional. Campaigners against austerity measures including many good disabled groups/individuals which I have had honor of standing with, have caught many a minister or media outlet telling downright lies, and challenged them at every opportunity only to be called extremists for pointing out the fact our government cost the taxpayer more money than it could ever save. They avoid taxes like the plague, they avoid punishing those who have been caught with their hands in the treasury pot with a backroom job after jail terms for fraud until they think people have forgotten about their shenanigans, they give themselves 10% pay rises when the rest only get 1%.

We buy and pay for two homes with furnishings, subsidise their sustenance in HOC Bar and Canteen, along with many other perks they get for doing their jobs for a nice fee, while taking on second incomes on various boards or corporations and in some cases getting paybacks for doing such a fab job of screwing the public over. How can that be right, that we the public allow this abuse of taxpayer’s money to continue without challenge. Some will argue it is justified, but I think it isn’t, when you compare some of the above costs for the worker to what they the Government cost us. When we have ministers who like George Osborne’s father in law Lord Howell, father of the Chancellor’s wife Frances, has previously boasted about Mr. Osborne’s influence over energy, saying he has driven the campaign against wind farms.

George also believes in fracking and supports that with vested interests, from ‘daddy in law’ while many other ministers are on health boards selling off our NHS, and various other corporate boards. While they think ‘cash is king’ and will solve all our problems, the rest of society is dying, (yes literally) and starving. While homelessness with the awful under occupancy aka ‘bedroom tax’ policy, which the UN says is unlawful and should be stopped immediately and against our Human Rights, are turning many to payday lenders to survive, feeding the debt monsters and insurance giants of tomorrow. More people are in debt now and Citizen’s Advice Centres and other money advice centres are seeing swathing cuts to funding so that they can help those in need and councils are cutting crucial social care and other services to our most needy.

As we come to party conference season Tories are buoyant on getting a second term, the Lib Dem’s talk carrier bags and are back peddling so fast to save themselves from the wilderness of politics, which is too late your ‘dead’ already, and Labour the so called party of the working man has remained silent thus far playing the long game. Then we see a rise in UKIP whose fascist viewpoint seem to appeal to those who are under cover racists along with the Tories (yes remember racist van) and the Greens trying to snatch a surprise while the others are napping. Scotland however is looking at Independence with glee and Wales have Plaid Cymru who no doubt will win again.

All this jockeying about to save us from a deficit that isn’t, and if it does exist we didn’t cause it, while those who did, get fat bonuses and payoff’s for a huge balls up. I will say this though, unless we stop this abuse of power it will continue?

Now I’m no politician, but I know what is right and wrong and this is so wrong it is inhumane and unjust. Our human rights are so badly abused now, people don’t even notice when they are gone. This dumbing down of the public and the rampant apathy is our biggest enemy even within our own communities.

If we really fight back we can have them running to the Tower of London for safety, they are already scared of us ‘the people’ which is why they launch attack after attack, while everyone trying to survive no one says hang on a minute! Classic divide and rule, and what grates me more and more is ‘WE’ the people ‘ALLOW’ it to happen. We are all taxpayers in one form or another and many have paid their NI stamps, yes the key ‘people police’ is insurance paid for tough times  when we were needing hand.

Time has come to save ourselves, because they wont!

Today I am pleading to every man ,woman, child  that this country needs your help more than ever. Under the coalition government this country has faced some of the most brutal cuts in the name of austerity not seen in a very long time, some are fighting back, but many are sitting idly by allowing this to happen in the name of capitalism, which is the class war of the rich  1% via the poor. We
have one common enemy THIS Government.

Groups of people in society are turning and fighting each other fed by the government and media rhetoric of Workshy, Scrounger, etc. We the people should not be fighting each other but uniting as one to fight back against the destruction of the Welfare State, of which the NHS is part of. Every day I hear another horror story of one description or another, someone dying because their mental health can take no more so they jump under a train or bus, someone who has lost their home because they cannot pay the bedroom tax, someone who needs help with a food bank because they have nothing left after bills to feed their families, or someone who needs help with ESA or DLA, or someone who cannot find a job and is being bullied to despair by the jobcentre when NO jobs are being created, turning  nationals against immigrants.

This has to stop immediately, doesn’t matter what your politics are, or what group in society you are labelled ie; disabled, pensioner, working on low-income, young person  etc we have to stop this national disgrace and stain on our country. Around the world we have always been seen as fair country and our reputation was  built upon that, yet we are being denied access to treatments when ill, the pathway to care killing our elderly, and access to justice denied to those working and non working. forget the disagreements  you may all have and  get this dictatorship out of office before it too late. If you can’t go on a protest write and lobby your MP’s, we can all do something regardless of our personal circumstances. Our NHS being ripped apart.  Make no mistake on this they are privatising this. Many of the MP’s and the Lords have vested interests in PRIVATE HEALTH CARE COMPANIES, and so do the CCG’S please, this is your NHS, every man, woman and child uses it. We all use a GP £25 a visit is not far away for unwaged and £150 for the waged recently being reported. How much do you CARE about the NHS?

If you have a pre existing medical condition, your insurance will be loaded with exemptions, or you may not get health insurance at all.  If you have been genetically tested many will not get  insurance, if these companies think you are high risk of developing the illness etc you have been tested for.

It is an abomination to sit by and let this happen to  leaving future generations in squalor & despair not seen since Victorian England, without hope of peace around the world, without jobs, without a future of the workhouse scenario, which I am sure they will start re- building soon. This government has become part of the USA style political scenario where you will need insurance for  everything.

This government is introducing a crime and anti social behaviour bill, simply put,if we picket because a union is striking, or we protest because we want to stand up for our rights and be counted, this government will stop it from
happening.  They will make it illegal.  You can be arrested if a group of you in a public place standing up for what you believe in. This government DO NOT WANT THE WORLD TO KNOW what is happening here.  So protests/picketing will be made illegal.  They are taking AWAY YOUR HUMAN RIGHTS DAILY. THE TRUTH HURTS.  People do not like the truth, they shy away from it, and bury their heads in the sand. People attack the brave people who stand up at great costs to themselves and stand up and speak out against what this government are doing. If we do not stand up now, tomorrow will be too late, we stand up to fight for not only us, but for your children, for all men women and children to come in the years ahead.  We fight for decent housing, employment, employment rights, decent health care, education available to all, access to all services for all, for all of our basic needs education, employment, health care housing, everything we take for granted this government want to stop. And they want to stop us fighting for this and will arrest us if
we speak out against it.  That is the truth !

Time and again people have said to us, “oh we wont sign that or get involved as it does not affect us, or believe the total propaganda rubbish the media constantly publish. The government have done their job well,  but people need to challenge what they read and see behind these lies, you are being hoodwinked into compliance. Someone who is working long hours and has no rights and cannot take their company to court as they would have to pay £1200 for it and cannot afford to get justice.  ITS ALL ABOUT OUR HUMAN RIGHTS, THIS GOVERNMENT WANT TO AND ARE TAKING THEM FROM YOU…. YOU ARE NOT HUMAN TO THEM JUST STOCK LIKE A COMMODITY ON STOCK MARKET THEY BUY AND SELL DAILY. We  implore you all to please stop attacking and arguing with each other, to please put your differences aside whatever they may be, and fight the one common enemy, and that is this GOVERNMENT.  We know that old feuds  go back years, in some cases, and some views are vastly different, but we all care about this country I hope enough to rebuild  our communities  and that is a good place to start with that common purpose. Show you care about your country and lets show this government we have had enough and  UNITE. My friends WE ARE RUNNING OUT OF TIME FAST, it is now time to act as one, SCARED,  I KNOW I AM !

Corruption in UK is rife by those who think because they have money they can abuse the rights of Individuals and  the Corporations they represent. Human Rights Abuses are many and it has to  STOP  !
Daily I hear the doom and gloom of the people being abused which are the poorest in society. People with ill health, being ruled unable to work, being told to get out homes because they are meant to downsize so a more worthy soul who works like a slave on minimum wage can have their home, and supports the ethos of the CONDEMS to cut welfare. I know that some people also abuse the system aimed to help them, but these have been proven to be a very small 0.5% of a few unscrupulous selfish individuals whose greed is the same as those in charge of some of the most powerful places in UK.,They have shares in Healthcare, Drug, Energy Companies,  and where are the biggest rises  and privatisations happening in this area of welfare.
The Public are slowly waking up to the plight of those on bottom rung as it starts to bite Middle England, but slow is the operative word. We have our politicians who are claiming all sorts as part of their jobs out of the taxpayers pot and all I have heard the last 3 years is Silence while they stick the boot in those unable to defend themselves, while they rub their hands at  owning their own home, the 4×4, two hols a year while never realising most those people claiming have also contributed to society and now they are in need are asking for assistance they were promised through national insurance…yes INSURANCE. Just like you insure your life or car many have paid 20/30/50yrs into a scheme that promised to look after them. if they needed.

Kicking the poor has become a new’ Olympic Bloodsport’  while those able to work and the well off bleat about spending their taxes on the most vulnerable in society rather than share that wealth, to have a more equal society.  Where humanity overrides selfishness and greed and for people to help those who can’t help themselves so they can have a little more and enjoy the basic of pleasures of  a friendly face or a cooked meal, and a warm home  .

They don’t complain while politicians and bankers and others claim for things they shouldn’t from the public purse, fiddle their expenses, and fund second homes with all the trimmings gets the thumbs up. How many readers of this blog would like a second home they didn’t have to fund, and holiday free gratis etc etc or a free pub meal down your local. I can tell you many would be glad to be able to feed themselves once a day, feed their kids, and keep themselves warm when needed, and cosseted when sick.

The silence to defend the indefensible is the biggest threat to humans since the dinosaurs extinction. It’s called the Blame game!

BLAME LIST

It isn’t rocket science to see who is blagging the system  and taking your taxes and it isn’t the most vulnerable in society. Many stealth taxes hit the poorest ,VAT being one of them we all pay regardless. Many also work.

If your working and earning a decent income when you go to your supermarket shopping, just stop and think for one second to see if you could buy a tin soup to put in the food banks trolley on your way out. If you see that person on the street begging stop and think and offer your loose change it may be only drink to keep warm they had for some time. Before anyone attacks me for this stance put yourself in that persons shoes ,they are not all drunks, druggies etc many are genuinely in a difficult place could you sleep on a street? I know I couldn’t. I may be able to go without food for a day or two but then I would be thinking of ways to get food which may lead me to commit a crime.

What a state of affairs we find ourselves in. I’m coming to what I call the latter end of ones average  lifespan and what I see today sickens me to my stomach more than any words I can type here. It is time to reverse and find humanity and compassion for our fellow-man because 10 years ago I was fit and healthy until life took me down a different path through no fault of my own. Check to see whether that old man/lady across road needs shopping or they are ok? Ask how someone you know who having a bad time is feeling /doing?

Let us dump one ‘C’ for four others Care, Compassion, Community, Campaign .

Atos-Saint or Sinner?


This company was paid a handsome sum of money to carry out the Work Capability Assessments (WCA) by Labour in 2008. A pilot scheme was set up (after an impact assessment ) and carried out and a review showed serious flaws which Labour were in the process of addressing when they lost office. The Condem Vilification of the Sick and Disabled went into full swing like a drunk in charge of a vehicle under the supervision of Ian Duncan Smith (IDS) . A car crash was about to ensue. The WCA was changed by IDS to the cruel ,biased test we know now.The Atos contract was changed and regulations are being changed consistently to ensure his introduced targets are carried out as exposed by Dr Steven Bick,and Joyce Drummond the so-called   ‘Atos Whistleblower’. So the disability community have always thought Atos is their enemy ,when the reality is that enemy is DWP and the Government. They blame Labour for introducing this, which they did,but no way was it as cruel as it is now it was in fact fairer. Were the deaths so high under Labour ..no they were not!

I was lucky to meet with Shadow Minister last week who told a delegation of campaigners (inc myself)  what I personally had suspected for some time, Atos are the governments scapegoats for failure, rather than the Government/DWP taking responsibility for an assessment process which was already flawed, being made worse by someone at the helm who threw caution to the wind, ignored the need for an impact assessment and by any means necessary was going to remove the vital support that people needed and who change regulations like they change their underwear. Atos Dr’s ,Nurses etc are not able to use the skills they trained years for,but are now Disability Analysts. The welfare of the Sick and Disabled do not come into it, if you can work one day a week then this is what they will say,this process  IS NOT A MEDICAL that many believe it is in fact a programme to work regardless of levels ability to do so,where it is possible. I know many will be outraged by these comments but that is the stark truth,I’m not going to dress it up or give you a sticky plaster for it. It is now costing more in appeals than to implement the test itself, a 9 month wait on DLA alone for appeals.

Atos are no angels they are banned in 15 countries for mismanagement so they are not off the hook entirely and are culpable in the suffering of our community but it seems what they took on,  in many places around the globe  were factors that lead to their failures also. The Sick and Disabled know it is fair to have assessments to make sure the genuine get the help they deserve, and work where they can,but this brutal regime will only get worse with the coming changes and more cuts next year with the introduction of Universal Credit,Bedroom Tax, PIP.

Now is the time to start laying the blame where it truly lies firmly and squarely on the doorstep of our present government,and realise the fact that unless we get behind Labour the only credible alternative we will be socially cleansed out of existence. I can hear you all screaming  ‘what Labour are you kidding me’, actually no I am not,while they made an attempt to make sure disability was taken into account and their original idea was flawed they are not to blame for the last two years destruction,we have suffered under this bunch., or for the harsh changes to the WCA or the constant changes to Atos contract and the hidden targets to get 7 out of 8 off benefits.

On reflection I can honestly say hand on heart that Atos are not the real enemy like any business they are fulfilling a contract what is being asked of them and struggling to do so because the staffing levels are not up to scratch to deal with the volumes the Government/DWP are pressuring then to achieve which is why the whole thing is a catastrophe.

I like many others blamed Labour for introducing it, which is unfair of me,it amazing when you get that lightbulb moment and you open your eyes  and realise that Atos also are scapegoats and the Real Culprits are laughing all the way to the bank as they asset strip our welfare system to keep the banks and themselves afloat at our expense. I asked why the deafening silence from Labour, the reality is they do not have majority on committees, the Tories and Lib  Dem’s do, hence the lack of perceived progress from Labour, who are fighting our corner in the background with Human Rights Abuses being lodged in EHRC.

I ask everyone to rise up against this let us get this lot out of office ,LETS KICK SOME BUTT!

There is a campaign of hate and bullying against the most vulnerable in our society – the sick and disabled.  The changes in the system of benefits is causing people not just unneccessary suffering but people are dying because of it.

I hope that you will read this and share it.

It seems to me that unless people are directly affected they don’t want to know.  But this is something that could be stopped if there was enough of a public outcry.

My father spent time in concentration camps during WW11 and was marched through the streets of Germany.  The question he, and I, always asked was how could the ordinary German people have allowed this to happen?  Now I understand.  They were too busy ‘coping with their own lives’, trying to make themselves feel better by partying, drinking, focussing on the good things, in denial, felt powerless etc etc.  And yet they stand accused of guilt by association.  We all know they could have done more to stop what was happening.

The same applies to us, today.  And yet I find that even on FB it is only those people who have been directly affected that take an interest.  People can’t even be bothered to read stuff, let alone go to the trouble of pressing a button and sharing the stories that demonstrate the depth of this crisis, the despair that people around them are experiencing or even the horror at the number of deaths.

People seem happy to share pretty, funny pictures, to share that they care about disasters and crimes in other places, to show their concern about animals, the environment etc etc.  And so am I, don’t get me wrong.  But they don’t want to know about what is going on under their noses, in their name.

We all know that stress makes you sick.  If you are sick it makes you sicker.  If you are very weak it can kill you.  Trying to get the benefits you are entitled to to ensure you can live while you deal with illness is incredibly stressful.

The number of people who have died is horrifying and this is a crisis that could affect you, your family and anyone that you love.

I feel so frustrated that we do not seem to be getting across to the general public how serious this is.

The Motto of this government is that work makes people healthier.

“Paul Mickleburgh, one of the world’s longest surviving kidney dialysis patients is hooked up to a dialysis machine for five hours, three days a week. He’s also had cancer and pneumonia and suffers from spontaneous internal bleeding, brittle bones a twisted bowel and agonising joint pains as a result of his renal treatment. He’s had four failed kidney donations.

To top it all off, Paul has had 14 heart attacks in the last five years and believes his last attack was caused in part by the stress of trying to deal with the DWP. Sadly, patients with chronic kidney disease are actually more likely to die from associated heart disease than from kidney failure itself.

In spite of this, Paul has been placed in the work-related activity group,(external link) meaning that he is someone who is expected to return to the workplace in the reasonably near future. Paul’s request for this dreadful decision to be looked at again came back with the same result – he should be moving towards a return to work.

We hope that Paul is now appealing . . . and that his heart will stand the stress.”  (From the Work and Pensions website)

RIP Karen Sherlock  (From diary of a benefit Scounger/Spartacus)

I just found out that Karen Sherlock, @pusscat01 has passed away.

Karen embodied our fight in almost every way. She was desperately ill. Her kidneys were failing, putting a huge strain on her body. Ultimately it seems she died of a cardiac arrest. An operation had recently been cancelled at the last minute, though I have no idea why or if it is relevant to her death.

She had been found capable of some work by the DWP. Placed in the Work Related Activity Group, her Employment and Support Allowance was time limited to one year after the welfare reform bill went through. Not only that, but it was limited retrospectively, meaning that she only had a few months left to appeal for long term support (Support Group) before she lost everything.

I won’t go into more detail here. It’s not for me to list her complaints and trials, but there is one thing everyone in this country should know.

She was terrified. Beside herself with fear. She lived her last months desperately scared that her family would not survive the onslaught it faced. She was “the most vulnerable” whatever that is. The system failed her and she spent her last precious moments in this world fighting. For herself, for her family and for others. She was one of us. She was Spartacus. And now she’s dead and she died in fear because the system failed her, because cruel men refused listen and powerful men refused to act. She spent her last months fighting for the “security” of £96 a week and the reassurance that it couldn’t be taken away. She won her battle. Just two weeks ago she was finally put into the Support Group of ESA. After months of unbearable stress, resilient commitment and endurance beyond comprehension, she won her battle.But she lost her war and we must all make sure that whatever comes, we win that war in her name and in the names of the many thousands more fighting for life and dignity. RIP Karen. We WON’T forget you.

OVER ONE THOUSAND PEOPLE HAVE DIED as a direct result of ‘reforms’ to benefits payouts ordered by the Conservative Liberal-Democrat Coalition Government in Westminster, with likely to be HUNDREDS OF SCOTS also among the dead, according to information published by the media after Freedom of Information responses revealed over 32 people are dying a week after having passed through work capability assessments carried out by by private firm ATOS, on a £100million a year contract to the ConDem coalition Westminster Government. ATOS made a £42million profit in 2010 and paid boss Keith Wilman £800,000, a 22% pay rise on the previous year.

With the revelations of the numbers of dead, Scots may now be entitled to ask – “Would a Scottish Government of an Independent Scotland hire a French based firm for £100million a year to do the same to Scots citizens and cause as many deaths ?” (errm No ! – Ed)

32 DIE A WEEK AFTER FAILING TEST FOR NEW INCAPACITY BENEFIT

More than a thousand ­sickness benefit claimants died last year after being told to get a job, we can reveal. We’ve highlighted worries about the controversial medical tests for people claiming Employment Support Allowance which are being used to slash the country’s welfare bill. The Government has boasted that more than half of new ­claimants are found “fit to work” – failing to mention that over 300,000 have appealed the decision and almost 40% have won. Instead, employment minister Chris Grayling says this ­”emphasises what a complete waste of human lives the current system has been”.

We’ve used the Freedom of Information Act to discover that, between January and August last year, 1,100 claimants died after they were put in the “work-related activity group”. This group – which accounted for 21% of all claimants at the last count – get a lower rate of benefit for one year and are expected to go out and find work. This compares to 5,300 deaths of people who were put in the “support group” – which accounts for 22% of claimants – for the most unwell, who get the full, no-strings benefit of up to £99.85 a week.

We don’t know how many people died after being found “fit to work”, the third group, as that information was “not available”. But we have also found that 1,600 people died before their assessment had been completed. This should take 13 weeks, while the claimant gets a reduced payment of up to £67.50 a week, but delays have led to claims the system is in “meltdown”.

Mr Grayling admitted last month that 35,000 people are waiting longer than 13 weeks. Commenting on the deaths of ­claimants, a Department for Work and Pensions official said: “It is possible that the claimant had already closed their claim and then ­subsequently died, meaning that these figures may be ­overestimating the true picture.” Of course, they’re bound to include some people who died of ­something completely unrelated to their benefit claim.

But there are plenty of tragic cases – such as that of David Groves (left) who died from a heart attack the night before taking his work ­capability assessment. The 56-year-old, from Staveley, Derbyshire, worked for 40 years as a miner and telecoms engineer but stopped on doctors’ orders after an earlier heart attack and a string of strokes. His widow Sandra said: “When Dave was called in for a medical, he felt like he was back to square one. “He was in a terrible state by the day he died. It was the stress that killed him, I’m sure.”

Stephen Hill, 53, of Duckmanton, Derbyshire, died of a heart attack in December, one month after being told he was “fit to work”, even though he was waiting for major heart surgery. Citizens Advice told us it has found “a number of cases” of people dying soon after being found fit for work. “There seems to be a clear link between the cause of death and the condition they were suffering from that led to the claim,” said Katie Lane, head of welfare policy.

“We have always supported the idea that people who could work and want to work should be helped to do that. But we are seeing a lot of seriously ill and disabled people being found fit for work. “We have serious concerns about whether the test used to decide if people are fit for work is the right test.” The work capability assessments are carried out by private firm Atos, on a £100million a year contract. The firm made a £42million profit in 2010 and paid boss Keith Wilman £800,000, a 22% pay rise on the previous year.

Thank you for your Freedom of Information request of 16 February 2012. You asked:

Can you please provide me with the number of ESA claimants who have died in 2011?

Can you please break down that number into the following categories:• Those who are in the assessent phase• Those who have been found fit to work• Those who have been placed in the work related activity group• Those who have been placed in the support group• Those who have an appeal pending

The table below provides data on the numbers of Employment and Support Allowance (ESA) claimants where the Department holds information on a date of death being recorded in 2011 and whose latest Work Capability Assessment (WCA) date (or activity towards assessment) was before the end of August 2011, the latest data available.

In total, between January 2011 and August 2011, some 8,000 claims ended and a date of death was recorded within six weeks of the claim end. This represents about 1% of the total ESA caseload in May 2011 (the latest caseload data available). The table below shows the position of these claims when they were closed.

Those in the Support Group receive unconditional support due to the nature of their illness, which can include degenerative conditions, terminal illness and severe disability. Note it is possible that the claimant had already closed their claim and then subsequently died, meaning that these figures may overestimate the true picture. Care should therefore be taken when interpreting these figures.

All figures have been rounded to the nearest 100.

Data on the number of ESA claimants that have died following a fit for work decision is not available, as the Department does not hold information on a death if the person has already left benefit. The Department does not hold information on the number of claimants who died whilst an appeal was in progress.

We then asked for: The total Employment and Support Allowance caseload figures most comparable with the ones in the FOI request, eg Jan-Aug 2011, showing how many ESA claimants are put in support group, WRAG group, fit to work or claim ended. Clarification on whether these figures are only new ESA claims or whether they include the transfer from Incapacity Benefit? Clarification on the six-week cut off figure – why was that selected?

We were told:

“As at August 2011 there were around 730,000 people receiving ESA. In the three quarters Jan-Sep 2011, 380,000 people left ESA.

It is not possible to provide the further detail you request. These figures only cover new ESA claims – claims from IB recipients are not included. The six-week figure is used routinely within the department when looking at where people go after leaving benefits.”

They show: 0.8% of benefit spending is overpaid due to fraud, amounting to £1.2 billion, and that this proportion is the same as in 2009/10.

While I agree the similarities are very  scary it has to be said, it thankfully has not gone that far as yet but many fear it will!
